Defamation of Character Questions

April 18, 2008

1. Give the definition of identity theft?
Identity theft is: “The fraudulent appropriation and use of someone’s identifying or personal data or documents, as a credit card.” Source: www.dictionary.com

2. How many people suffer from identity theft, each year, worldwide? Make a hyperlink to the page from where you obtained your stats.
About 500,000 to 700,000 people a year suffer from this “attack” known as identity theft. Source: http://investor.com.com/2010-1071-958328.html

3. What is character defamation?
“Defamation of character is the attempt to defame another.”
Source: reference.thesaurus.com

4. Are there currently any defamation of character lawsuits going on in Spain? Give a minimum of three sentences describing the lawsuit and include a hyperlink to the article.
There are several lawsuits going on in Spain that affect the defamation of character, although they affect both persons involved in the case, for example there are laws that protect the accused; so they aren’t really strict laws.
Source: http://www.antorcha.net/biblioteca_virtual/politica/godwin/52.html

5. What are the dangers of posting videos on YouTube, or any related site? Give a minimum of 5.
The following dangers are the most common on posting videos on any site:
• The attraction of a pederast towards you.
• The stealing of your identity (if you say your name or any other personal data).
• The quarrel of your living or any other establishment from you.
• The defamation of yourself; for example: “Did you know he was in prison?”
• The intimidation towards another person by laughing at him and then posting it.

6. Find two newspaper reports or stories that discuss today’s dangers of internet use, such as chatting, YouTube, etc. Summarize these articles in your own words and put a hyperlink at the bottom of the summary to the article.
One report is about a Panda Software’s report on how internet is really harmfull. It showed several statistics like: 25% of children over 5 years of age and 75% of the children between 15 and 17 years of age use the internet” or “44% of minors who surf the web have felt sexually hounded” (source: http://www.lawdit.co.uk/reading_room/room/view_article.asp?name=../articles/Children%20in%20danger%20-%20the%20internet%20menace.htm).
Another article I found talks about the use of Parental Controls, such as Canguro Net, Panda’s Parental Control, etc. It talks about how the teens suffer many internet abuse, and how most of them are in risks on contacting pederasts (source: http://www2.state.id.us/AG/protecteens/index.htm)

7. How can images damage your school’s reputation or your own? Give an example of a situation that you have seen that could have been damaging had it been put on YouTube.
Images can damage my school’s reputation or even my own by making strange or simply other people coming to our school to investigate more about it, and the people inside; like pederasts. It can also damage my reputation by making other people think too much about me or a simple gesture can make them laugh. It can also go to the point of going against the law, because posting videos in the internet with the background of the school or showing other people identity without the assent of the parents (if it is a minor) is not allowed by the own law.

Since all of my days at school I’ve never experienced a situation of damaging posted in YouTube and don’t think this is going to happen.

8. If you wish to put something on YouTube that involves a school related project what steps must be taken?
I should first take the authorization of the people involved in it, and don’t show much about ourselves, physically and personally (our name, our living, etc.). If it is recorded at the school, I would only show a corner or any place that doesn’t show where the school is, how it is, or how it is called, because this could attract unsuspected visitors.

9. Do we need to protect ourselves from others only, or also from ourselves?
We need to protect from others and from ourselves. We need to be careful on what we post or what we say at the image or video because it could make our image worst.

10. How can computers been found? How can the police find out that your computer was responsible for posting something illegal?
Computers can be found by revealing the IP address of the computer accessing the internet. By this been revealed they can see the owner of the computer. All computers have a dynamic IP (except servers) that change every time we access the internet, but they also have a static IP and that one is the one in which the police knows who is the owner of the computer because it never changes. The police’s process to know your computer was responsible for posting something illegal is to find out from what IP did it came from and from there, they find out who post it.

11. How can you protect yourself from stalkers or pedophiles finding you on the internet?
We can protect us from stalkers or pedophiles that find you on the internet, by not posting personal photos in rare sites or just public sites, because they don’t have much control like private pages, that you need to log in to go inside the site.

12. Is technology creating unforeseen problems in our lives? Give at least two examples in areas beyond identity theft and defamation of character; give at least two examples of other areas.
Technology is creating unforeseen problems in our lives making us too sociable like sharing many personal data, the not knowing of who can watch us; study us, and even finding were we live, and the misspelling of words because of the modern speed writing with computer and mobiles (ex. Instead of writing: “See you” many people write in this language: “cya”). Net-meeting can be a good example on another area, because we can believe she/he is wonderful, but when they meet on real life, they say, “Was I really sharing my feelings with that person?” Another example can be the chatting, which is like net-meeting but more with friends, it could seem safer, but it is really not; there are people that go adding contacts to their list to get their credit card number, their personal information, etc.
